Terms and Conditions
General rental conditions:
- The minimum age is 23 years, For ages under 23, an amount of 10 euros per day will be added.
- Holding a valid driver’s license for at least 2 years.
- Document of identification (passport or ID card) along with valid driver’s license.
- The shortest rental period is 3 days.
- Payment is made in cash or by a valid bank card issued in the name of the renter or one of his/her companions.
Article 1
Terms of use:
- The renter is obliged to take care of the vehicle, keep it and it is not allowed to be used by anyone else other than the person specified in the rental agreement, nor is it allowed to use it contrary to traffic and legal regulations in Bosnia and Herzegovina.
- It is not allowed to use the vehicle to transport persons, or other persons’ items or property for a fee.
- It is not allowed to transport more passengers than the designed capacity of the vehicle.
- It is not allowed to carry prohibited substances or items that may cause damage to the vehicle due to their excessive weight, odor, or condition, or that will prevent or delay the Company in the next rental of the vehicle.
- It is not allowed to use the vehicle to push or tow any other vehicle, trailer, or anything else.
- It is not allowed to use the vehicle for racing, testing, competition, or any illegal purpose.
- It is not allowed to drive on unpaved roads, or forest roads.
- It is not allowed to drive under the influence of alcohol, psychoactive substances, drugs, sedatives, or any other substances that weaken consciousness or ability to react.
- It is not allowed to sub rent the vehicle (rent it from the renter).
- It is not allowed to drive a vehicle outside B&H except with the written consent of the Company, and after submitting all the necessary documentation by the renter.
- It is not allowed to drive a vehicle in geographical areas that the Company has notified to be prohibited or pose a danger to the renter or the vehicle.
The renter undertakes and agrees to:
- Take responsibility for all legal consequences and obligations, to bear all costs, expenses, and compensation to the Company for any losses incurred to the Company and any damage that occurs on the vehicle, resulting from the renter’s violation of the above conditions of use, in accordance with this Agreement.
- All above conditions apply to all vehicles of Safari rent a car, and Safari rent a car shall not be responsible for loss or damage to any rented vehicle caused by non-compliance with the above terms and conditions.
Article 2
Pick-up and return of vehicle:
- The shortest rental period is three days with a maximum overdraft period of 60 minutes starting from the end of the agreed period.
- In case of the client’s delay with the return of the vehicle after the allowed period of delay, Safari rent a car reserves the right to impose additional daily fees at the current price, including fees for options taken for each day.
- The client is obliged to return the vehicle at the end of the period specified in the Agreement and no extension is allowed except after notifying Safari rent a car and obtaining consent to extend the Rental Agreement for the required period. If the client does not return the vehicle on the specified date or does not notify the company of the extension, the Agreement will be automatically renewed and the Company will determine the rental fee it deems appropriate and charge the renter any and all costs or losses caused to the Company due to failure to return the vehicle on time, non-notification and non-obtaining of the consent from the Company.
- The Rental Agreement shall remain in force until the renter returns the vehicle to the agreed place of return.
- By accepting the vehicle, the renter confirms that the vehicle is in the same condition as determined in the vehicle inspection report and that he/she accepts full responsibility for any damage or additional loss to the vehicle no matter how it occurred. The renter also bears full responsibility for the vehicle until its return and recorded arrival of the vehicle by an authorized representative, as confirmed in writing by the Company.
- The renter agrees to return the vehicle with all documentation and equipment (such as spare tire, equipment box) in the same condition as it was at the pick-up time, on the day and at the time specified in the Agreement.
- The Company reserves the right to request the return of the vehicle at any time in the event that the vehicle is used in a manner that violates the terms of this Agreement, or if the renter is unable to fulfill its financial obligations to the Company.
- If the renter returns the vehicle beyond office hours, he/she is obliged to follow the instructions related to the return outside office hours for that location, which was determined by the Company. In any case, the renter bears full responsibility for the vehicle until the location starts operating and until the return of the vehicle is registered by the Company.
- The Company shall not be liable to the renter, or to any passenger or third party, in connection with losses or damages incurred on assets left in the vehicle, regardless of whether during the rental period or later on.
- The responsibility for these assets shall be fully borne by the renter during the term of the Agreement.
- If the vehicle requested by the renter is not available, the Company may allow the change to a more modern model and only for temporary use. As soon as the requested vehicle is available within the category of rental paid by the renter, the Company will contact the renter to make a replacement, in which case, the renter is obliged to return the vehicle as soon as the Company requests so.
- Early termination of monthly agreements causes the imposing of higher fees. The calculation shall be made based on the prices valid for the days actually used.
- If the vehicle is not returned at the expected time of arrival, the fee will not be aligned on the agreed day, or in the case of using the vehicle in a way that violates the terms of the Agreement, the Company reserves the right to:
- Report to the police about the theft of the vehicle.
- Take the vehicle without prior notice to the renter.
- File a lawsuit against the renter for non-payment of due amounts of the fee.
- File a lawsuit for deferred rental fees.
Article 3
Personal data
The renter authorizes the Company to provide his/her personal data to the competent authorities such as the police, traffic departments, criminal investigation administrations and other relevant authorities.
Article 4
Prices and changes
Prices are subject to change if the booking changes after the confirmation date. When the renter intends to change the original rental period by extending or reducing the rental days, the renter declares that the Company reserves the right to change its prices accordingly.
Tax: Our prices include value-added tax, vehicle registration costs, and other vehicle-related issues. Prices do not include fees for the use of highways, parking, violations, or any other costs, which will be borne by the renter of the vehicle during the rental period.
Fuel: The vehicle is to be returned in the same condition as it was when picked up. It is required to pay attention to the amount of fuel in the Agreement when picking up the vehicle.
Mileage: Within Bosnia and Herzegovina, there’s no mileage limit, but outside of Bosnia and Herzegovina, it’s limited to 300 kilometers per day. For each additional kilometer, a charge of 0.30 euros is applied.
Article 5
cancellation and delay – no show
- If the renter does not show up on the term agreed for the rental, he/she will be charged EUR 100.
- If canceled up to 48 hours before the pick-up term, no fee will be charged. If does not make a cancellation or give notification 48 hours in advance, he/she will be charged EUR 50.
- Security amount and deposit: This is the amount of funds paid at the beginning of the rental when picking up the vehicle and it will be returned directly on the occasion of returning the vehicle, if the renter has not violated any of the rental conditions or caused damage to the vehicle.
Payments
- For car rental, a bank card issued in the renter’s name is required.
- Payment via the Internet is accepted using VISA or Mastercard electronic bank cards, in BAM or EURO currency.
- Credit card details and personal identification data of the client will not be stored, sold, shared or leased to any third party.
Article 6
Damage, inconvenience or theft, and similar:
- The renter bears full responsibility for any damage caused to the vehicle, especially if it occurs due to contaminated fuel and/or due to driving over flooded areas and/or damage caused by water and/or macadam roads.
- In the event of an accident (with or without damage to the vehicle) or any personal injury, or theft of the vehicle or any part of the vehicle, the renter must immediately notify the Company and police about the event, in order to obtain a valid police report after all the necessary documents, information and actions required by the police have been submitted and exhausted. The renter’s obligation is to submit a copy of the police report to the Company. If the renter does not succeed or fails to provide the Company with a copy of the police report, he/she shall be responsible for paying the actual costs incurred to the Company as a result of the loss of the vehicle or the damage caused to it.
- The renter is obliged not to take any action that could affect the retention or validity of the insurance policy, and in particular the non-recognition of liability to any third parties. On the contrary, the renter shall be solely liable for compensation to a third party.
- In any case, the renter agrees to make compensation of damage in full if the insurance company rejects the insurance claim, due to the renter’s failure or in case any third party sues the Company for renter’s certain actions or his/her non-payment.
- The renter undertakes to assist the Company Safari rent a car or its insurance companies in all claims or legal issues related to the event or any damage to the vehicle. The renter shall also have the same responsibilities in cases of theft.
- If the police report does not identify the third-party responsible for the event, the renter shall bear all costs and payments incurred to the Company or the amount of the bigger obligation in accordance with the type of insurance selected and agreed by the renter (if any).
- The costs of damage to windows and car tires shall be borne by the renter unless they are covered by the insurance specified in the Agreement.
- The insurance does not cover damage that occurs to the lower part of the vehicle, the interior of the vehicle, the gearbox, and the engine if it was caused by negligence or poor use.
- The Company Safari rent a car has the right to cancel the insurance policy if the renter fails to comply with the terms of this document. In this case, the renter shall be responsible for all costs, damages, and losses incurred to the Company due to his/her failure.
- The insurance shall not bear any compensation when the vehicle is driven by a person not specified in the Agreement.
- In a car accident, the renter pays 1,000 euros if he chooses the Basic insurance, but he choose the premium insurance, he only paid the amount of the deposit, which is 300 euros
Article 7
Applicable law and jurisdiction
- This Agreement is interpreted and understood in accordance with the law of B&H, and local laws applicable in Sarajevo.
- If there is a dispute between the two parties, it will be resolved in the court of competent jurisdiction.
- This Agreement is made in two counterparts, one for the owner (the rental Company) and the other for the renter.
I declare that I have read and understood the terms and conditions of this Agreement and I fully agree thereto.
